No NEET Re-Exam, Supreme Court Says “Can’t Conclude Sanctity Breached”

Asper the media source by The Hindu, The Supreme Court on Tuesday refused to cancel the undergraduate National Eligibility-cum-Entrance Test (NEET-UG) 2024 held on May 5, while observing there is no material on record “at the present stage” to prove that a systemic leak of question papers has destroyed the sanctity of the exams held annually for medical admissions across the country.

“At the present stage, there is an absence of material to show that the result of the exam stands vitiated… Data produced city-wise, centre-wise and comparison of results in 2022, 2023 and 2024 do not show a systemic leak of question paper which indicate a destruction of the sanctity of the exam,” Chief Justice of India D.Y. Chandrachud, heading a three-judge Bench comprising Justices J.B. Pardiwala and Manoj Misra, reasoned.

Asper the media statements highlighted by NDTV there will be no re-test for the NEET 2024 exam, the Supreme Court said Tuesday, reasoning there is no data to suggest a “systemic breach” or that the “sanctity” of the examination, following two localised leaks of the question paper, had been affected.

The court admitted the fact the question paper was leaked is “not in dispute”, but said there is no material on record at this time to conclude “the result of the exam was vitiated or (that) there was a systemic breach in the sanctity of the exam”. “Data on record is not indicative of a systemic leak of the question paper, which would lead to the destruction of the sanctity of the exam…” the court said.

The court was hearing a clutch of petitions demanding the NEET-UG test – a qualifying examination for undergraduate medical courses – be either held again or cancelled.
